The amended version of the Tree Preservation Order is adopted for the purposes of the new Kiama Local Environmental Plan 1996 with such Order to take effect upon the date of commencement of that plan.
Notice is hereby given that under the provisions of clause 8 of the Environmental Planning and Assessment Model Provisions, 1980, as adopted by Kiama Local Environmental Plan 1996, the Council of the Municipality of Kiama has, by resolution, made a Tree Preservation Order with respect to any tree growing on any land within the area with the exception of:
Such order hereby prohibits without the written consent of the Council of the Municipality of Kiama the ringbarking, cutting down, topping, lopping, removing, injuring or wilful destruction of any tree which is situated:
- is three (3) metres or more in height
- has a girth of 200 mm or more and a height of one (1) metre from the ground
- has a branch span of three (3) metres or more.
The Order takes effect from the date of commencement of the Kiama Local Environmental Plan 1996.
Any person who contravenes, or causes or permits to be contravened, the provisions of the Tree Preservation Order shall be guilty of an offence. All requests for the Council's consent to the ringbarking, cutting down, topping, lopping, injuring or removing of any tree specified in this order may be made in writing to the General Manager, Kiama Council, Council Chambers, Manning Street, Kiama.
